Creditors’ Rights

DBS Law clients are frequently creditors, whether voluntarily or involuntarily, having made loans or simply having obtained a judgment against a wrongdoer. Our attorneys are prepared to advise creditors of the remedies available to them in collecting money owed. DBS Law can also represent creditors throughout the process of exercising those remedies, from determining assets available for potential recovery to creating liens and executing on those assets. Where a debtor has entered bankruptcy or another insolvency proceeding, DBS Law is also experienced at representing creditors throughout those proceedings to ensure their claims are maintained to fullest extent possible.

Receiverships

Attorneys Dan Bugbee and Dominique Scalia regularly serve as court-appointed receivers in both Washington and Oregon courts. In this capacity, they have assisted in the liquidation and recovery of assets under court supervision. Cases that they have been employed in have included the following:

 

  • Appointed at request of secured lender to liquidate high-end Mercer Island residence in the center of complex multi-party litigation.
  • Appointed at request of the Washington State Attorney General to take control of insolvent non-profit following embezzlement of funds by former management. During this receivership, the non-profit was stabilized, operations were transferred to a new non-profit, and over $1 million dollars was rerecovered from insurers for the benefit of creditors.
  • Appointed in partnership litigation dispute to take charge of operating maritime business to both provide financial oversight and analyze past accounting. By working with both partners, the business operations were stabilized, and an agreed budget was implemented, resulting in the business being fully operational for the upcoming season.
  • Appointed through voluntary assignment by former cannabis processor to locate, retrieve, and liquidate assets in hands of would-be surviving entity following failed merger.
  • Appointed over segment-leading seller of branded beverage products to operate and liquidate going concern.

Bankruptcy & Insolvency

DBS Law attorneys are experienced in all aspects of bankruptcy and other insolvency proceedings, representing debtors, creditors, and even trustees and receivers. Clients have the benefit of DBS Law’s experience working with parties on both sides, from banks to individual debtors. Where litigation is initiated within an insolvency proceeding, DBS Law is equally capable of continuing to represent clients through all stages, including trial.
